The new JCT Contracts 2011 cover new payment legislation and other important updates. The JCT 2011 Contracts should be used for construction contracts entered into after Part 8 of the new Construction Act comes into force (expected October 2011). Consequently the JCT Contracts 2011 published before the Part 8 of the Construction Act comes into force will make it clear that they should not be used prior to that date. Appropriate:
For use where the main contract is the Standard Building Contract (with quantities, without quantities or with approximate quantities); Where the Contractor is to design discrete part(s) of the main contract works (contractor's designed portion) and: The Subcontractor is to design all or part of the subcontract works (subcontractor's designed portion). Can be used:
Where the subcontract works and/or main contract works are to be carried out in sections; For subcontract works that are to be carried out on the basis of an adjusted subcontract sum (adjustment for variations etc.) or by complete re measurement. Not suitable;
Where no subcontractor's design is involved consider the Standard Building Subcontract (SBCSub/A and SBCSub/C).
Replaces: DSC/A/DP and DSC/A/DPSC.
